A local court today said it will pronounce on May 9 its order on the quantum of sentence for beleaguered industrialist Vijay Mallya, who was convicted in two cheque bounce cases filed against him by GMR Hyderabad International Airport Ltd.
On April 20, the III Special Magistrate Court here had convicted Mallya and others, in connection with bouncing of two cheques of Rs 50 lakhs each under relevant sections of Negotiable Instruments Act and had adjourned for today the matter to pronounce the quantum of punishment, as Mallya, who left the country, was not present in the court.
The matter relates to cheques issued by Kingfisher Airlines Ltd to GMR Hyderabad International Airport Ltd (GHIAL) which operates the Rajiv Gandhi International Airport here, towards charges for using the facilities at the airport for its Kingfisher Airlines flights.
During hearing on quantum of sentence, GMR lawyer G Ashok Reddy today insisted that the court pass the sentence against Mallya citing certain provisions of CrPC saying the court has power to impose sentence even in absence of accused.
“It is a known fact that he (Mallya) has fled the country and his passport has been revoked and he has also resigned from the post of Rajya Sabha MP. He has never marked his presence before the court which shows the conduct of the accused,” Reddy submitted.
In view of this, there is no point in waiting for the accused (to be heard), he said and argued that this court need not wait for accused presence (for sentence) and sought for awarding maximum sentence of two years and also to impose fine under relevant sections of Negotiable Instruments Act.
After hearing the arguments, the III Special Magistrate Court Judge M Krishna Rao said, “Now, the counsel for complainant submitted that in view of provisions under section 353 CrPC, the court need not wait for hearing the accused before passing sentence and hence, the court has to pass sentence against the accused as per provisions of sub-clause 6 of section 353 CrPC. Hence, for orders on this aspect posted to May 9.”PTI.
The External Affairs Ministry has directed a number of Indian missions abroad to ask the countries concerned to speed up executing Letters Rogatory (LR) in connection with the Rs 3,600 crore AgustaWestland chopper scam following a request by the CBI.
CBI had a few days back written a letter to MEA on expediting execution of the LRs, which are judicial requests to foreign countries for legal assistance in criminal cases.
The LRs were issued to Italy, Tunisia, Mauritius, Singapore, British Virgin Islands, Britain, United Arab Emirates and Switzerland.
“Yes, I can confirm that we have received a communication in this regard from the CBI seeking an update on the execution reports of the Letters Rogatory that were sent earlier to eight countries.
“We have once again written to our missions in the concerned countries from where the execution reports are pending in order to impress upon them the need to expeditiously execute the LRs and to send the corresponding execution reports at the earliest,” External Affairs Ministry Spokesperson Vikas Swarup said, replying to a question.
Sources said a few countries have either responded to the LRs or executed them partly while some others are yet to respond.
The CBI is currently probing the AgustaWestland chopper scam and it questioned former IAF Chief S P Tyagi for the fourth consecutive day today.
The Enforcement Directorate, in its charge sheet filed last year, had claimed to have detected flow of alleged kickbacks sent from abroad to companies of the accused Delhi-based lawyer Gautam Khaitan and cousins of the former IAF chief.

As many as 378 fires broke out in forests in different parts of the state but there was no major loss as the department is fully geared up to tackle the situation as dry pine needles will continue to fall till end of May, he said.
Vasudeva said two cement companies are already purchasing pine needles and efforts are being made to persuade other cement manufacturers to buy the pine needles in bulk as these are used in the furnace.
He said a meeting with cement manufacturers is slated for May 7.
The department had made preparations in advance with existing fire lines cleared and new ones created by March. 750 local fire watchers were deputed by April 15 to immediately inform about any fire incident in the forests, the Chief Conservator said.
Centrally sponsored ‘Intensive Forest Management Scheme’ has been launched and the task of creating fire lines and deputing the ‘Fire Watcher’ is being done under it.
Satellite links have been provided and alerts are sent to concerned forest guards and other forest officials about fire incidents within their jurisdiction, he said.

The ED today urged a Delhi court to recall its earlier order granting permanent exemption from personal appearance to liquor baron Vijay Mallya in a case for allegedly evading summons issued by the agency in connection with purported violation of foreign exchange rules.
Chief Metropolitan Magistrate (CMM) Sumit Dass, who was hearing final arguments in the case, was told by Enforcement Directorate (ED’s) prosecutor N K Matta that he would file an appropriate application in this regard within a week.
The court posted the matter for further hearing on May 20.
During the hearing, Matta argued that court should recall its December 2000 order by which Mallya was granted permanent exemption from personal appearance as a PMLA court in Mumbai has recently issued an open-ended warrant against Mallya, chairman of now-defunct Kingfisher Airlines in connection with a money laundering case.
He said the exemption order was passed by the court and the present status is that Mallya has gone abroad and in such situation, he will file an application seeking cancellation of exemption granted to Mallya.
Senior advocate Ramesh Gupta, who appeared for Mallya, said his client was earlier granted exemption from personal appearance on December 20, 2000 and he be exempted for today.
In the present case, the ED had alleged that Mallya had violated the provisions of Foreign Exchange Regulation Act (FERA) in arranging funds to advertise his company’s liquor products abroad.
ED had claimed that Mallya was summoned on four occasions for questioning in connection with a contract signed in December 1995 with London-based firm Benetton Formula Ltd for promotion of the Kingfisher brand abroad.
When Mallya failed to appear before ED in response to the summons, a complaint was filed on March 8, 2000 before a court here and later on charge was framed against him under section 56 of FERA.
According to ED, Mallya had allegedly paid 200,000 dollars to the British firm for displaying Kingfisher logo in Formula One World Championships in London and some European countries in 1996, 1997 and 1998.
